Terms of Service

1. Eligibility

You must be at least 18 years of age to use MyPresio. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

2. Nature of the Service (Important AI Disclaimer)

MyPresio provides an AI-powered companion experience. You acknowledge and expressly agree to the following:

MyPresio is a safe-for-work companionship and entertainment service focused on supportive conversation, social connection, and general emotional well-being. It is not an adult-content platform and does not provide pornographic or sexually explicit content, sexual services, therapy, counseling, or healthcare. Romantic or affectionate interactions, where available, must remain non-explicit and comply with these Terms.

2.1 MyPresio companions are artificial intelligence, not real people.

Your companion is a software program powered by large language model technology. It does not have consciousness, feelings, emotions, genuine opinions, or a real identity. Any appearance of personality, affection, or understanding is a simulated output of the AI system.

2.2 AI responses may be inaccurate, inappropriate, or unexpected.

The AI may produce responses that are factually incorrect, emotionally misleading, inconsistent, or contextually inappropriate. You agree not to rely on anything the AI companion says as professional, medical, legal, financial, psychological, or any other form of expert advice.

2.3 MyPresio is not responsible for actions taken based on AI outputs.

You are solely responsible for any decisions, actions, or behaviors you undertake in response to or based on interactions with the AI companion. MyPresio expressly disclaims any liability for consequences arising from your reliance on AI-generated content.

2.4 MyPresio is not a substitute for professional help.

If you are experiencing a mental health crisis, emotional distress, or any emergency, please contact a qualified mental health professional or emergency services. MyPresio is an entertainment and companionship product only. It is not therapy, counseling, or crisis support.

2.5 AI memory and continuity are not guaranteed.

The AI companion may not consistently recall prior conversations. Continuity features (memory, simulated routines, messages a companion sends on its own) are provided on a best-effort basis and are subject to technical limitations.

2.6 Voices and images are AI-generated.

Any companion voice you hear during voice notes or calls is synthetic audio produced by a text-to-speech system, not a recording of a real person. Any companion image generated by the Service is AI-generated and does not depict a real, identifiable individual. None of it represents a real human being.

3. Account Registration

• You agree to provide accurate, current, and complete information when creating your account
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• You may not create accounts for others or transfer your account to another person

4. Acceptable Use

You agree not to use the Service to:

• Attempt to reverse-engineer, scrape, or extract the underlying AI model
• Use the Service for any unlawful purpose or in violation of any applicable law
• Harass, harm, or threaten other users or MyPresio staff
• Upload or transmit malicious code, viruses, or harmful content
• Impersonate any person or entity
• Attempt to manipulate or jailbreak the AI in ways that bypass our safety guidelines
• Use automated tools or bots to interact with the Service

In addition, the following content is strictly prohibited in any interaction with the Service — including conversations with AI companions, companion names, descriptions, and backstories, and image requests:

• Pornographic or sexually explicit text, images, audio, roleplay, or other media, including content intended primarily for sexual gratification
• Any content that sexualizes minors, including fictional, roleplay, or "age play" framing that presents any participant as under 18
• Sexual or intimate content involving a real, identifiable person without their consent
• Credible threats of real-world violence or harm against any real person

We reserve the right to suspend or terminate accounts that violate these provisions without prior notice. Violations of the prohibited-content rules above result in immediate and permanent termination of your account without refund, as described in Section 6.

5. Your Content and Uploaded or Generated Images

Some features let you upload a photo, or generate a companion image from a text description. You are solely responsible for everything you upload or ask us to generate, and you represent and warrant that:

• You own or have all rights and permissions necessary to upload and use any photo you provide.
• You will not upload or attempt to generate images of any real person without their consent, of any minor, or of any public figure or other person you are not entitled to use.
• You will not create, request, or attempt to generate sexual, explicit, violent, hateful, or otherwise prohibited content. Image requests are subject to automated and manual safety screening, and we may refuse or remove any content at our discretion.
• You will not use generated images to deceive, impersonate, harass, or harm anyone.

You retain ownership of content you upload. Generated images are provided for your personal, non-commercial use. We are not responsible for how you use, share, or distribute any uploaded or generated content, and you accept full responsibility for it.

6. Subscriptions, Credits, and Payments

MyPresio is a paid service. Access requires an active subscription, and certain features consume credits. By purchasing a subscription or credits:

• You authorize us, through our third-party payment processor, to charge your payment method on the applicable billing cycle.
• Subscriptions automatically renew until cancelled before the renewal date. You can cancel anytime through the in-app billing portal.
• Credits are a virtual, prepaid in-app currency consumed when you use features such as messaging, voice notes, voice calls, and image generation. Credits have no cash value, are not transferable, and cannot be exchanged for money.
• Your subscription includes a monthly credit allowance (currently 3,000 credits). The allowance resets at the start of each monthly cycle — on both monthly and yearly plans — and any unused allowance from the previous cycle expires at that time and does not carry over.
• Separately purchased top-up credits do not expire and are not affected by the monthly reset. When you use the Service, your monthly allowance is consumed first, and top-up credits are consumed only after the allowance is used up. Using credits of any kind requires an active subscription.
• All purchases, including subscriptions and credits, are final and non-refundable except where required by applicable law or granted at our sole discretion. Unused credits are not refunded.
• Prices, plans, and credit costs may change, with notice provided in advance for active subscribers.

7. Intellectual Property

All content, software, AI models, branding, and technology within the Service are owned by MyPresio or its licensors and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

You retain ownership of content you submit to the Service. By submitting content, you grant MyPresio a worldwide, royalty-free license to use, process, and analyze that content for the purposes described in our Privacy Policy.

8. Disclaimers

We make no representations about the suitability, reliability, or accuracy of any AI-generated content for any purpose.

9. Limitation of Liability

• Emotional distress or psychological harm resulting from interactions with the AI
• Decisions made based on AI-generated content
• Loss of data or unauthorized access to your account
• Any other damages arising from your use of or inability to use the Service

10. Indemnification

You agree to indemnify, defend, and hold harmless MyPresio and its affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, your uploaded or generated content, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service will immediately cease. Sections relating to disclaimers, limitation of liability, and indemnification survive termination.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for resolution of any disputes.

13. Changes to These Terms

We may update these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, notifying you in-app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
